Privacy Policy for Plonk App

  1. Introduction
    1. This Privacy Policy ("Policy") sets out how the Plonk App (Plonk being a brand created by Conviviality Group Limited, registered address is Whitchurch Lane, Bristol BS14 0JZ), (“Bibendum”, "we", " us", "our") collects and processes information about you when you download and use our Plonk application ("Plonk"). By continuing to use Plonk you consent to your information being processed in accordance with this Policy.
    2. Plonk has been designed to help users find the wine styles they like, wherever they are. Please refer to the Plonk Terms and Conditions for further details on the use of Plonk.
  2. Information we collect and how we use it
    1. When using Plonk, you will give us information that can identify you ("personal information"). We will use your personal information for the purposes set out in this Policy and below.

      Information collected through Plonk

      Purpose(s) for which it is used

      To make use of Plonk. When you download Plonk and create an account ("Account") we will ask you to provide information including your first and last name, gender, date of birth, email address, country and postcode. You will also have a unique password which enables you to access your Account.

      Alternatively, you can also create an Account using your Facebook credentials. The personal information we will ask you for in this case is your Facebook ID, first and last name, gender, date of birth and email address.

      We will not collect your Facebook username or password, but we may collect details from Facebook that confirm whether you are logged-in to Plonk using your Facebook account (a "token").

      This information is collected to allow you to use Plonk and to provide you with location-based functions, such as to help us to make the grape varieties and wine styles you like more available on your local supermarket shelves and wine lists. It also allows you to personalise and use Plonk interactively.

      Details obtained from Facebook through the token are used to access and extract certain information about you from your Facebook profile to enhance your user experience and provide you with meaningful content. This is information that you make available to the public on your profile. We do not access your personal account settings.

      We may also use this information for administrative and troubleshooting purposes (for example, to determine which parts of Plonk should be improved).

      Sharing images through Plonk. In addition, you may choose to upload images/photographs (which may include your or others' identifying features) ("Images") to i) a gallery on Plonk that is shared with other users and/or ii) your social media account (for example, your Twitter account).

      We may need to access the photo album on your device in order for you to upload such image, but we will only collect the image you upload.

      We will use the Images for the purposes of creating an interactive shared gallery on Plonk and to allow you to share Images with your friends via social media. In addition, we may use the content that you upload/post to Plonk for our marketing materials if you opt in to receiving marketing from us and to include on the Plonk and/or Bibendum website.

      We may also use this information for administrative and troubleshooting purposes (for example, to determine which parts of Plonk should be improved).

    2. As explained in Section 2.4 below, we may also use this information for further purposes when combined with other data we collect about you.
    3. Information we collect automatically. When you use Plonk, we may automatically collect the following information: your log-in information; operating system version; screen resolution; device processing power and memory; download errors; user behaviour (such as length of Plonk use); and any number of unique identifiers associated with your mobile device, for example an IMEI address (a unique number assigned to mobile phones that is used by GSM networks to help them identify valid mobile devices). We collect information automatically through the use of various technologies including "unique device identifiers" ("IDs"); this is explained further below.
    4. We use the information we collect automatically: (i) to administer Plonk for internal operations including troubleshooting purposes; (ii) to ensure that content from Plonk is presented in the most effective manner for you and your device(s); (iii) as part of our effort to keep the App safe and secure; (iv) to measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising and marketing materials to you[; and (v) to make suggestions and recommendations to you and other users of Plonk about goods or services that may interest you or them.
    5. Information we receive from other sources. We may receive information about you if you use any of the other services provided by Bibendum and its affiliates. We also work closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, social media companies) and may receive information about you from them (including information that is publicly available).
    6. Where permitted by law we may combine information we receive from other sources, including from social media websites, with information you give to us and information we collect about you, including ID information. We may use this information and the combined information for learning more about your preferences, for enhancing your user experience on our Apps and for providing you with information, content and offerings tailored to your needs.
  3. How we share and disclose your information
    1. We store your personal information on our systems in the European Economic Area to allow you to use Plonk in the same way irrespective of the device that you are accessing it from.
    2. We may share your information with Bibendum affiliates for the purposes outlined in this Policy. We may also share your information with third parties when: (1) it is necessary to involve a third party service provider in order to facilitate or extend our services; (2) explicitly requested by you (e.g. with social media networks); (3) required by a court order or any legal or regulatory requirement; (4) in connection with the sale or transfer of a business for fulfilling our obligations to you; (5) to enforce our Terms and Conditions; (6) to ensure the safety and security of our users, consumers and third parties; and (7) to protect our rights and property and the rights and property of our guests and third parties.
  4. How to opt in or opt out of direct marketing
    1. We may use the information you give us through Plonk for direct marketing purposes to provide updates, newsletters, articles, events, competitions or other communications in relation to Plonk that we think may interest you. Where required by law, your prior consent will be obtained before sending direct marketing. In any event, we will offer you the option to unsubscribe in every communication sent.
  5. IDs and other technologies
    1. We collect information automatically through the use of IDs. An ID is a specific string of numbers and letters (a "character string") which is assigned to your device but does not name you. The ID allows us and our selected third parties to track your behaviour when you use Plonk. Almost every App uses ID technology. IDs serve a number of purposes such as remembering your preferences and generally improving your user experience.
    2. IDs may tell us, for example, whether you have used Plonk before or whether you are a new user. This functionality makes IDs extremely useful to improve your user experience.
  6. What types of IDs do we use?
    1. We use different categories of IDs (such as Analytics IDs) which fulfil important functions within Plonk. You may disable these IDs via your mobile device settings or by using the links provided in the list below. However, there are two broad categories of IDs: (1) IDs that are essential for the operation of Apps (also known as Strictly Necessary IDs) enable features without which you would not be able to use Apps as intended. Your consent is not required for the use of Strictly Necessary IDs, which is why Strictly Necessary IDs cannot be disabled using the features of or the links on App. However, you have the option to completely disable IDs in your device at any time; and (2) IDs which, in strictly legal terms, are not essential to use the App. Nevertheless, these IDs do still fulfil important functions. You may disable any of these IDs via your mobile device settings or by using the links provided in the list below. However, if you do so this may prevent certain features or services of Plonk from working properly and therefore affect your experience whilst using Plonk. The list below shows the full range of IDs we may use with our Apps.

      Strictly Necessary IDs. These IDs are necessary to provide you with services available through Plonk and to use some of its features, such as access to secure areas. Without these IDs it would not be possible to provide Plonk services, such as a personalised App function.

      Analytics IDs. These IDs collect information that is used, either in aggregate form to help us understand how Plonk is being used or how effective our marketing campaigns are, or to help us customise Plonk for you. This information will not be stored on your device. It will also be used for the purpose of evaluating your use of Plonk, compiling reports on Plonk's activity and providing other services relating to App activity and usage.

      Google Analytics

      Social Media Plug-ins. On some parts of Plonk third parties that provide applications through our Apps may insert their own technology ("plug-ins") in order to track the success of their applications or customise applications for you.   For example, when you share an Image using a social media sharing button on an App (e.g., Facebook), the social network that has created the button will record that you have done this. Because of how these plug-ins work, we cannot access this technology, nor can the third parties access the data in the IDs used by us. Some parts of our Apps may also contain embedded content and these sites providing such content may set their own IDs or plug-ins.


      If you want to prevent this you must first log out of your Facebook account before activating the Facebook plug-in. Alternatively, you can disable all Facebook settings on your device when using Plonk.


      Log out of your Twitter account before activating the Twitter plug-ins, or alternatively and then disable all Twitter settings on your device when using Plonk.

    3. Your ID and plug-in opt-out preferences can be stored on your device. Therefore, please note that if you use a different device you may need to renew your opt-out choices.
  7. Data Retention
    1. We will not retain your information for longer than is necessary for our business purposes or for legal requirements. However, please be advised that we may retain some information after you have closed your Account with us and/or uninstalled the App, for instance if doing so is necessary to meet our legal obligations such as retaining the information for tax and accounting purposes.
    2. Please also note that any information held by third parties will be subject to the terms of their privacy policies and that we will have no control over that information.
  8. Your rights
    1. If you wish to obtain a copy of personal information that we hold about you, to correct, amend or delete information that is inaccurate, you may be able to do so by accessing your Account (if you have one). Otherwise, please contact us at the address set out in paragraph 13 below. Before responding to your request we may ask you to verify your identity, provide further details about your request and, where requesting a copy of your information, to pay a fee (currently fixed at £10.00). We will endeavour to respond within an appropriate timeframe and, in any event, within any timescales required by law.
    2. You can also close your Account at any time by contacting us at the address set out in paragraph 13.
    3. It is your responsibility to ensure that you submit true, accurate and complete information to Plonk and keep any Account up to date. You may also update your personal information by contacting us using the contact details provided below. Please make sure to include your name, username and post code in your initial correspondence; this helps us protect the details and preferences on your Account from unauthorised access.
  9. Information security
    1. We apply appropriate technical and organisational security measures to protect your personal information that is under our control from unauthorised access, collection, use, disclosure, copying, modification or disposal. All information you provide to us is stored on secure servers.
    2. However, please note that no transmission over the Internet or any public network can ever be guaranteed completely secure and we cannot accept any liability for any security compromise to transmissions over such networks. You are responsible for keeping your Account password secure and confidential.
  10. International Data Transfers
    1. The information that is collected through Plonk will be hosted on servers based in the European Economic Area. To the extent that it is necessary to transfer your information to any third parties, this means that your personal information may be transferred to a country which does not have equivalent protections to the laws of the country in which you are resident. However, your personal information will at all times be protected in accordance with this Policy and subject to applicable law.
  11. Use of this Apps by minors
    1. You must be at least eighteen (18) years old or older, and the legal drinking age or older in your jurisdiction, to use Plonk. Users who are aged under eighteen (18) are unable to use Plonk and create an Account. We will cease to process users' information as soon as we find out they are under eighteen (18), or under the legal drinking age in their jurisdiction.
  12. Changes to the Policy
    1. This Policy was last updated on 31 July 2017. You may find the latest version in the Privacy area under the settings menu of Plonk. We may change, modify, add or remove any portion of this Policy at any time. We will post any changes to this Policy on Plonk and at the same time will send you an e-mail detailing such changes. Changes will be effective on the date that they are posted on Plonk, or such later date that may be specified in the changes.
  13. Questions about this Policy
    1. This App is maintained by Bibendum and its service providers. If you have a question, concern or complaint about this Policy or our handling of your information you can contact us by email on or by post at Bibendum Wine 109a Regents Park Rd, London, NW1 8UR.
  14. Consent
    1. By installing and using Plonk and accepting the Terms and Conditions you expressly consent to Bibendum processing any personal information you provide to use through this App as set out in this Privacy Policy, including the processing of your personal information by our service providers. You may withdraw your consent at any time by contacting us at the address set out in paragraph 13 above, in which case we will stop this processing (unless we have an alternative justification for such processing).
    2. If you do not consent to Bibendum processing any personal information through this App, as set out in this Policy, you should uninstall and not use Plonk.
